Submission Terms and Conditions, Guidelines, Procedures, License, Waiver, and Release
These Submission Terms and Conditions, Guidelines, Procedures, License, Waiver, and Release (collectively “Terms and Conditions”) apply to the production currently entitled GHOSTHUNTERS (“Series”). By sending a Submission (as defined below) to the Series, you agree to be bound by these Terms and Conditions. Unless otherwise prohibited by applicable law, these Terms and Conditions set forth and govern all rights between you, on the one hand, and Pilgrim Media Group, LLC (“Producer”) and AE Networks, LLC (“Network”) and their respective parents, affiliates, successors, licensees, and assigns on the other hand.
During the exhibition of the Series, or at any other time, viewers may send photos, artwork, videos or other original materials to Producer via online submission to the website located at: OfficialGhostHunters.com, subject to change from time to time at Producer’s discretion (each, a “Submission“). You agree and acknowledge you have received good and valuable consideration for your Submission, including, but not limited to, Producer’s and Network’s consideration of your Submission and the possibility of inclusion of your Submission in the Series or publicity about your Submission and/or the Series.
Eligibility: You must be at least 18 years or the age of majority where you reside, and a US citizen or legal resident of the US to contribute a Submission.

Rights in and Use of your Submissions:
The decision to make use of any Submission is solely at Producer’s and Network’s discretion, and Producer and Network have no obligation to do so. By providing a Submission, you grant Producer and Network, their respective licensees, successors, and assigns a worldwide, royalty free, perpetual, irrevocable, non-exclusive, and fully sub-licensable and assignable license to use, reproduce, modify, adapt, edit, publish, translate, create derivative works from, distribute, perform, and display your Submission (in whole or in part) in and/or in connection with the Series, in any other program, or in any advertising, promotion and publicity, in any form, in any and all media now known or hereinafter devised, throughout the universe, in perpetuity. Producer and/or Network may, in their sole discretion, post or mention your first name, last name, city and/or state, in connection with use of your Submission, without additional credit, compensation, notification, permission or approval. By making a submission, you waive any moral rights of authors, droit moral, and/or any rights under the Visual Artist Rights Act.
General Conditions:
· Submission MUST: be original, truthful, and created solely by you.
· Submission MUST NOT:
o contain any obscene, offensive, libelous, defamatory, tortious, derogatory, unlawful or otherwise inappropriate material as determined by Producer and Network in their discretion;
o contain any music;
o contain any confidential information or information that could identify any third party;
o infringe any rights of any third party, including, but not limited to, copyright, trademark, privacy and publicity rights, or violate any law or regulation; or
o be generated by a script, macro or other automated means, or be incomplete, illegible or corrupted.
By making a Submission, you represent and warrant your Submission will comply with the above General Conditions. You further acknowledge and agree you are solely and entirely responsible for any Submission that you submit and the consequences of your Submission, and that the Submission does not intend or otherwise claim to reflect the views of Producer, Network, or any Series sponsors. Producer is not responsible for lost, damaged or misdirected Submissions under any circumstances. You assume all liability for any injury or damages caused or claimed to be caused by your Submission, and you agree to indemnify, release and hold harmless Producer, Network, Series sponsors, and each of their respective parents, subsidiaries, affiliates, successors, licensees and assigns, and their respective officers, directors, agents, equity holders and employees (collectively, the “Released Parties”) from any and all claims, actions, damages, losses, liabilities, costs, expenses (including, without limitation, attorneys’ fees), injuries or causes of action (collectively, “Claims”) whatsoever that in any way are caused by, arise out of or result from, your creation and submission of the Submission, the exercise of any rights or permissions granted herein, the inclusion of the Submission in the Series or any other work, the distribution, exhibition, publication, or other exploitation of the Series or any other work, or the use of your Submission or any works derived from your Submission by the Released Parties, on any legal theory whatsoever, including without limitation, Claims for idea misappropriation, copyright infringement, trademark infringement, unauthorized use of name and/or likeness, invasion of privacy and defamation. You acknowledge and agree you are solely responsible for any injury or damage you may incur as a result of submitting your Submission, including by way of submitting to any person’s computer or mobile device or entering or downloading materials or software in connection with said Submission. Released Parties are not responsible for telecommunications, network, electronic, technical or computer failures, or human error of any kind, for inaccurate transcription of Submissions, or for Submissions that are stolen, misdirected, garbled, delayed, lost, late, or damaged.
Producer and/or Network may review all information submitted in each Submission for indecency. Any Submission that is considered to be obscene, pornographic, libelous, hate speech or otherwise objectionable, in whole or in part, will be disqualified. Submissions will be deemed submitted at the moment of your Submission.
You acknowledge that Producer and/or Network will rely on the permissions, representations, and rights set forth in these Terms and Conditions at potentially substantial cost to Producer and/or Network and you hereby agree not to assert any Claim of any nature whatsoever against anyone relating to the exercise of the rights and permissions granted herein.
Privacy:
By visiting this page you agree to Producer’s privacy policy located online at https://www.pilgrimmediagroup.com/privacy-policy/, including policies regarding the collection, use, sharing and/or deletion of certain personal information you may share in connection with your Submission (collectively “Privacy Policy”). Producer and/or Network may engage third party application providers and other vendors to administer certain aspects of the Submission entry process, including without limitation, the online collection of personal information, entry information, and Submissions. Such third parties will provide your personally identifiable information to Producer, who will use such information in accordance with the Terms and Conditions herein and its Privacy Policy, and such third parties may also use your information for their own independent purposes in accordance with their own independent privacy practices. Producer and Network are not responsible for the storage or any use of your entry information by such third parties.
Nature Of Relationship:
By making a Submission, you hereby acknowledge and agree your relationship with Producer and Network is not a confidential, fiduciary, or other special relationship, and your decision to provide your Submission to Producer for the purposes herein does not place the Producer/Network in a position that is any different from the position held by members of the general public with regard to elements of your Submission. You understand and acknowledge Producer and/or Network have wide access to ideas, stories, designs, and other literary materials, and new ideas are constantly being submitted to them or being developed by their own employees. You also acknowledge many ideas or stories may be competitive with, similar or identical to your Submission in theme, idea, plot, format or other respects. You acknowledge and agree you will not be entitled to any compensation as a result of any use of any such similar or identical material. You acknowledge and agree Producer and/or Network do not now and will not have any duty or liability, direct or indirect, vicarious, contributory, or otherwise, with respect to the infringement or protection of any copyright in and to the Submission or any element thereof.
Relief/Disputes/Arbitration:
In the event of any breach or alleged breach of these Terms and Conditions by Producer, Network or any of the other Released Parties, you acknowledge and agree the damage, if any, caused to you thereby will not entitle you to seek or obtain injunctive or other equitable relief, and your rights and remedies, if any, will be strictly limited to the right, if any, to recover compensatory monetary (but not punitive or consequential) damages in an action at law, and you will have neither the right to rescind or terminate Producer’s, Network’s or their respective licensees’ or assigns’ rights and permissions as granted herein, nor the right to enjoin the production, exhibition or other exploitation of the Series or any other work, or any subsidiary or allied rights with respect thereto, nor will you have the right to terminate your obligations hereunder by reason of such breach or alleged breach.
You acknowledge and agree these Terms and Conditions set forth the entire agreement between Producer and you with respect to the subject matter hereof and may not be altered or amended except in writing signed by both parties. You agree to submit to jurisdiction in the State of California. Any Claim shall be governed by and construed in accordance with the substantive laws of the State of California without regard to California choice of law rules. All Claims shall be submitted to final and binding arbitration, to be held in Los Angeles County, California, before a single arbitrator, in accordance with California Code of Civil Procedure §§ 1280 et seq. The arbitration shall be initiated and conducted according to the applicable JAMS Arbitration Rules and Procedures, except as modified herein, including the Optional Appeal Procedure, at the Los Angeles office of JAMS, or its successor (“JAMS”) in effect at the time the request for arbitration is made. The arbitrator shall follow California law and the Federal Rules of Evidence in adjudicating the dispute. The parties waive the right to seek punitive damages and the arbitrator shall have no authority to award such damages. Notwithstanding the foregoing, nothing in this paragraph or in the applicable rules of the JAMS shall prevent Producer, its licensees or assignees from seeking equitable and/or injunctive relief outside of arbitration, with or without posting any bond, pending the arbitrator’s final decision.
You have read and understand these Terms and Conditions and agree to the provisions contained herein.
Further Documentation:
If Producer and/or Network deem it necessary to secure additional assignments, certificates of engagement for the Submission or other documents as Producer and/or Network may reasonably require in order to evidence or effectuate the rights granted in these Terms and Conditions, then by making a Submission, you agrees to sign, authenticate and deliver any such required additional documentation upon Producer/Network’s request.
